なぜ今このタイミングなのか。「知的財産推進計画2026」(2026年6月12日 知的財産戦略本部決定)は、プリンシプル・コード(仮称)の制定とあわせ「クリエイター等への対価還元に向けた環境構築を促進する」ことを今後の方向性として掲げた。一方、そのコード案への意見募集(2025年12月26日〜2026年1月26日)では、権利者側と事業者側から鋭く対立する意見が寄せられ、修正検討が続いている。制度がまだ固まっていない今しか、設計そのものを提案できる時期はない。
第一節

提言の要旨

生成AIと著作物をめぐる議論は、「学習データを開示させるか否か」という一本の軸の上で膠着している。だが権利者が本当に必要としているのは、学習データの一覧ではない。自分の作品が使われたかどうかの確認と、使われた分の対価だ。事業者が守りたいのは、営業秘密である収集手法とアーキテクチャである。

この二つは、実は両立する。開示を求めるのではなく、照合を可能にすればよいからだ。

作品の側にハッシュ値(デジタル指紋)を持たせ、その照合結果だけを記録する。事業者は学習データを一件も公開せずに済み、権利者は自分の作品についてのみ「使われたか否か」を機械的に確認できる。そして使われた回数に応じ、スマートコントラクトが自動で対価を送る。

「使わせない」でもなく、「原則自由」でもない。
第三の道は、使わせる。ただし使った分だけ自動で払う。

これを UCA(Universal Creative Attribution/普遍的創造的帰属) と名づけ、その設計と段階的な実装方法を以下に述べる。

第二節

現状認識──対価還元は、いま訴訟でしか実現していない

生成AIの学習をめぐる紛争は、現に金銭の移動を生み始めている。米国では、大手AI開発事業者が書籍の無断利用に関する集団訴訟について総額約15億ドルの和解に至ったと報じられた。対象は約50万点、一点あたり約3,000ドルの一律配分と伝えられている。

ここに、現行の紛争解決手段の限界がそのまま現れている。一点あたりの金額が一律である以上、それは「どれだけ使われたか」とは無関係だ。一度しか参照されなかった作品も、モデルの出力に強く影響した作品も、同じ額を受け取る。

訴訟という道具は、権利の有無を裁くには適していても、
寄与の量を測るようにはできていない。

そして日本国内の議論は、著作権法第30条の4による広い許容と、欧州型のオプトアウト方式との間で揺れている。「使わせない」か「原則自由」かという二択のままでは、いずれを選んでも、使われた量に応じて対価が流れるという最も自然な帰結にはたどり着けないのではないか。

必要なのは、新しい禁止でも新しい自由でもない。計測の仕組みである。

第三節

論点の転換──「開示」ではなく「計測」で解く

プリンシプル・コード(仮称)(案)への意見募集では、原則1の開示項目についてクローラの識別子やアーキテクチャの詳細の開示は競争上の機微情報の流出を招くとの指摘がなされ、原則2の個別開示請求については濫用と工数負担の懸念が、原則3については十分な根拠を欠く探索的請求を許容しかねないとの懸念が示されたと承知している。

これらはいずれも正当な懸念であり、かつ「開示」という手段を採る限り解消しない性質のものだ。開示範囲を広げれば事業者の負担と競争上の不利益が増し、狭めれば権利者の納得が得られない。範囲の調整でこの対立を解くことは、構造上むずかしい。

しかし、視点を一つ動かせば景色が変わる。権利者が知りたいのは「学習データの全体像」ではなく「自分の作品一点について、使われたか否か」である。これは開示を伴わずに答えられる問いだ。

意見募集で示された懸念UCAによる応答
原則1:クローラ識別子・アーキテクチャ等の細かな開示は競争上の機微情報の流出を招く学習データそのものは一切公開しない。公開されるのは「照合に応じる仕組みを備えている」という事実のみ。透明性の要請を、機微情報を出さずに満たす。
原則2:個別開示請求は膨大な工数を要し、事業者のリソースを圧迫する照合は自動処理であり、人手の介在を要しない。請求件数が増えても限界費用はほぼ増えない。
原則2:司法手続を回避・代替する仕組みとなることへの懸念照合結果は事実の記録にとどまり、権利義務の判断を代替しない。むしろ訴訟における証拠収集の円滑化に資する。
原則3:根拠を欠く探索的請求(フィッシング・エクスペディション)を許容しかねない照会者は自らハッシュ値を提示できる作品についてしか照合できない。原理的に探索ができない構造である。

付言すれば、「コンプライ・オア・エクスプレイン」という枠組みにおける「エクスプレイン」を、文章による説明ではなく機械可読な記録に置き換えられる点も、実務上の意義は小さくない。説明の巧拙が評価を左右する状態は、誠実な事業者にとってかえって不利に働きうるからだ。

第四節

UCAの構成──三本の柱

作品登録時にSHA-256ハッシュ値をブロックチェーンに刻む。「誰が、いつ、何を創ったか」が改ざん不可能な形で永続記録される。書籍・音楽・画像・映像のいずれにも適用可能。
第二の柱
スマートコントラクトによる
自動対価還元
利用のたびに自動的に著作者へ対価が流れる。仲介する組織を介さず、コードが契約を執行する。一回0.001円でも、一億回使われれば十万円になる。
第三の柱
ハイブリッド設計による
個人情報保護との両立
チェーン上にはハッシュ値のみを記録し、氏名・住所等はオフチェーンの暗号化DBに保管。「忘れられる権利」と「改ざん不可能性」を同時に満たす。法改正を要しない。

無方式主義を損なわない

日本が採る無方式主義は、創作の瞬間に権利を発生させる。しかしそれは、権利を証明する手段までは与えていない。ハッシュの記録は、無方式主義を損なうことなく──登録はあくまで任意である──証明の空白だけを埋める。

価格を事前に決めない

著作物の価値を事前に見積もることは、ほぼ不可能だ。無名の写真が突然広く使われることもある。であれば、使われた量そのものに価格を決めさせればよい。誰も使わなければゼロ、多く使われれば相応の額になる。作者は値をつける必要がなくなる。

音楽配信サービスの分配モデルに似ているが、決定的に異なる点がある。それらは仲介事業者が収益の大半を取る。UCAは仲介を置かず、スマートコントラクトが直接支払う。

第五節

段階的な実装案

全体を一度に立ち上げる必要はない。法改正を要しない範囲から着手し、実績を積んだうえで制度整備に進むのが現実的である。

ハッシュ付与と検証ツールの公開 法改正 不要
デジタルアーカイブ機関等が保有する資料の一部にSHA-256ハッシュを付与し、管理主体のプライベートチェーンに登録。検証ツールを一般公開する。プリンシプル・コードに賛同する事業者が任意で照合に応じる運用を並行して試行する。現行法の範囲内で実施可能。
第2段階
対象拡大とパブリックチェーン連携 一部 法改正
対象資料を拡大し、パブリックチェーンとの連携を開始。照合記録を証拠収集手続において利用しうる位置づけとして整理する。著作権法第31条の補完規定、電子署名法の政令整備が必要。
第3段階
自動マイクロペイメントの本格稼働 法改正 必要
スマートコントラクトによる自動対価還元を開始。絶版作品・権利者不明作品への対価還元を技術的に実現する。

第1段階は、その気になれば年度内にも着手可能な内容である。「対価還元に向けた環境構築の促進」という方針に対し、まず動く実物を一つ持つことの意味は大きいのではないか。

第七節

量子計算機時代への備えと、国際標準化

耐量子計算機暗号への段階的移行

現行のSHA-256は、今日の計算機にとっては事実上解読不能である。だが量子計算機の本格稼働が現実となる2030年代以降、この前提が揺らぐ可能性がある。米国国立標準技術研究所(NIST)は2024年に耐量子計算機暗号の標準化を完了した。重要なのは、いま完全な答えを出すことではなく、設計思想の中に「移行可能性」を最初から埋め込んでおくことだ。技術仕様の具体化にあたっては、情報処理推進機構(IPA)および産業技術総合研究所との連携が適当と考える。

世界を変えた概念には、必ず名前があった。「インターネット」「ブロックチェーン」「オープンソース」。名がつくことで、概念は伝播する。UCAという名を提案するのは、この構想が日本発の概念として国際的に流通しうると考えるからだ。

現在、生成AIと知的財産をめぐる国際的な議論は、規制の強度をめぐる対立に終始している感がある。そこに「計測して払う」という第三の設計を提示できる国は、まだない。

提出者について

日昇リサーチ株式会社は、姓名科学の研究普及を目的として設立した小規模な法人である。提出者は現在73歳、かつて日産自動車株式会社において輸出業務および中近東向け販売に従事し、外国為替管理の実務に携わっていた。

この提言を書く動機について、一言だけ添えておきたい。私の妻は作曲家として日本音楽著作権協会に所属している。作品が使われているのかどうかも分からぬまま、確かめる手段も持たぬ側の心境を、日常のこととして見てきた。同時に私自身は、日々の業務において生成AIを道具として用いる利用者でもある。この提言の文案作成にも生成AIを用いた。その開発元は、まさに第二節に記した和解の当事者である。

禁じる側にも、使う側にも、私は片足ずつを置いている。
どちらか一方の立場から言っているのではない。

The dispute over generative AI training has stalled on a single axis: whether operators must disclose their training data. What if it were solved by matching rather than disclosure? On the timing. Japan's Intellectual Property Promotion Plan 2026, adopted by the Intellectual Property Strategy Headquarters on June 12, 2026, set out the establishment of a Principles Code together with the promotion of "an environment for returning value to creators." Meanwhile, the public consultation on the draft Code (December 26, 2025 – January 26, 2026) drew sharply opposed comments from rightsholders and from AI developers, and revision is ongoing. There is no later moment at which the design itself can still be proposed.

Section 1

Summary of the proposal

Debate over generative AI and copyrighted works has stalled on a single axis: whether training data must be disclosed. But what rightsholders actually need is not an inventory of training data. It is confirmation of whether their own work was used, and payment for the use. What operators need to protect is their collection methodology and architecture — trade secrets.

These two are in fact compatible. Not by requiring disclosure, but by making matching possible.

Give each work a hash value — a digital fingerprint — and record only the result of matching against it. The operator publishes not a single item of training data; the rightsholder can mechanically confirm, for their own work alone, whether it was used. And in proportion to the number of uses, a smart contract sends payment automatically.

Neither "you may not use it" nor "use is free by default."
The third path: use it — but pay automatically for what you used.

This is named UCA (Universal Creative Attribution). Its design and a staged path to implementation follow.

Section 2

Where we are — remuneration currently happens only through litigation

Disputes over AI training have already begun to move money. In the United States, a major AI developer was reported to have settled a class action over unauthorised use of books for approximately USD 1.5 billion. The settlement was reported to cover some 500,000 works at a flat rate of roughly USD 3,000 each.

The limits of the current mechanism are visible in that figure. Because the per-work amount is flat, it bears no relation to how much each work was used. A work referenced once and a work that strongly shaped the model's output receive the same sum.

Litigation is a tool for adjudicating whether a right exists.
It was never built to measure how much a work contributed.

Domestic debate in Japan, meanwhile, oscillates between the broad permission of Article 30-4 of the Copyright Act and the European opt-out model. So long as the choice is framed as "prohibit" or "permit by default", neither option reaches the most natural outcome: payment flowing in proportion to use.

What is needed is not a new prohibition, nor a new freedom. It is a mechanism for measurement.

Section 3

Shifting the question — solve it by measurement, not disclosure

In the consultation on the draft Principles Code, it was noted that disclosure of crawler identifiers and architectural detail under Principle 1 risks leaking competitively sensitive information; that individual disclosure requests under Principle 2 raise concerns about abuse and workload; and that Principle 3 could permit exploratory requests lacking adequate grounds.

These are all legitimate concerns, and they are of a kind that cannot be resolved so long as the mechanism is disclosure. Widen the scope and operators bear greater burden and competitive harm; narrow it and rightsholders are not satisfied. Adjusting the scope cannot structurally resolve this opposition.

But shift the vantage point one step and the picture changes. What rightsholders want to know is not "the overall shape of the training data" but "for this one work of mine, was it used or not?" That question can be answered without any disclosure.

One further point. Within a "comply or explain" framework, the "explain" can be replaced by a machine-readable record rather than a written account. This is of no small practical significance, because a regime in which the quality of the writing determines the assessment works, perversely, against the more conscientious operator.

Section 4

The architecture of UCA — three pillars

On registration, a SHA-256 hash is inscribed on a blockchain. Who created what, and when, is recorded permanently in a form that cannot be altered. Applicable to books, music, images and video alike.
Pillar two
Automatic remuneration
by smart contract
On each use, payment flows to the author automatically. No intermediary organisation stands in between; code executes the contract. Even at a hundredth of a yen per use, a hundred million uses is a meaningful sum.
Pillar three
Privacy preserved through
hybrid design
Only hash values are recorded on-chain; names and addresses reside in an encrypted off-chain database. The right to erasure and immutability are satisfied simultaneously. No legislative amendment is required.

Formalities remain unnecessary

Japan, like all Berne signatories, grants rights at the moment of creation without formality. But that grant does not supply any means of proving the right. A hash record fills only that evidentiary gap — registration remains entirely voluntary — without touching the no-formalities principle itself.

No price is set in advance

Estimating the value of a work in advance is close to impossible. An obscure photograph may suddenly be used everywhere. If so, let the volume of use set the price. Nothing used, nothing paid; heavily used, paid accordingly. The author no longer has to put a number on their own work.

This resembles the distribution model of music streaming services, with one decisive difference: there, intermediaries take most of the revenue. UCA places no intermediary in the path; the smart contract pays directly.

Section 5

A staged implementation

The whole need not be stood up at once. It is realistic to begin within the scope that requires no legislative amendment, accumulate a record, and only then proceed to institutional arrangements.

Stage 1
Hash assignment and a public verification tool
Digital archive institutions assign SHA-256 hashes to a portion of their holdings and register them on a private chain under their own management. A verification tool is made publicly available. In parallel, operators subscribing to the Principles Code voluntarily trial responding to matching queries. Feasible within existing law.
Stage 2
Broader coverage and public-chain interoperation
Coverage is extended and interoperation with public chains begins. Matching records are positioned as usable within evidence-gathering procedures. Requires a supplementary provision to Article 31 of the Copyright Act and an ordinance under the Electronic Signature Act.
Stage 3
Automatic micropayment in full operation
Automatic remuneration by smart contract begins. Payment for out-of-print works and works whose rightsholders cannot be identified is achieved technically. Requires legislative amendment.

Stage 1 could, given the will, be started within the current fiscal year. Against a policy of "promoting an environment for returning value to creators", there is considerable significance in first having one working thing.

That is the essential point of the design.
Section 7

Preparing for the quantum era, and international standardisation

Staged migration to post-quantum cryptography

SHA-256 is, for today's computers, effectively unbreakable. But once quantum computers enter genuine operation — from the 2030s onward — that premise may weaken. The US National Institute of Standards and Technology completed standardisation of post-quantum cryptography in 2024.

What matters is not producing a complete answer now, but embedding the possibility of migration into the design philosophy from the outset. In specifying the technical detail, collaboration with Japan's Information-technology Promotion Agency (IPA) and the National Institute of Advanced Industrial Science and Technology (AIST) would be appropriate.

Naming the concept

Concepts that changed the world all had names. "The internet." "Blockchain." "Open source." A name is how a concept travels. UCA is proposed as a name because this design could circulate internationally as a concept originating in Japan.

International debate on generative AI and intellectual property currently turns almost entirely on the intensity of regulation. No country has yet put forward a third design: measure, then pay.

About the submitter

Nissho Research Co., Ltd. is a small company established for research and dissemination in an unrelated field. The submitter is seventy-three years old and previously worked at Nissan Motor Co., Ltd. in export operations and Middle East sales, handling foreign exchange administration.

A word on why this proposal was written. My wife is a composer and a member of the Japanese Society for Rights of Authors, Composers and Publishers. I have watched, as an everyday matter, the position of a rightsholder who cannot tell whether her work has been used and has no means of finding out. At the same time I am myself a daily user of generative AI in my work — including in drafting this proposal. Its developer is a party to the settlement described in Section 2.

I have one foot on the side that would prohibit,
and one on the side that uses.
